Welcome to Focused Scribe! Please read these Terms of Service ("Terms") carefully before using focusedscribe.com and its associated writing tools. These Terms govern your access to and use of Focused Scribe.
By accessing or using any part of our service, you agree to become bound by these Terms. If you do not agree to all the terms and conditions, you may not access or use the service.
1. Ownership of Your Creative Content
You retain 100% full copyright, intellectual property, and moral ownership of all words, manuscripts, prose, character sheets, world-building notes, and documents you write or import into Focused Scribe. We claim zero ownership, license, or rights to your creative works. Furthermore, we guarantee your writing is never used to train or evaluate artificial intelligence models.
2. User Warranty for Imported Writing, Assets & Authoring Tool Status
Focused Scribe is an interactive creative productivity, outlining, and drafting application—an authoring tool, not a publisher, content host, or distributor. Focused Scribe does not publish, curate, broadcast, sell, or publicly host your writing or creative assets. Any distribution, sharing, compilation, or publication of work created, formatted, or organized within Focused Scribe is conducted solely and independently by you at your own discretion and risk.
By using Focused Scribe, you explicitly represent and warrant that:
- Ownership and Licensing: You hold all necessary intellectual property rights, titles, licenses, permissions, and clearances for any and all writing, manuscripts, lore, character text, visual assets (including background art, photographs, moodboards, and character sprites), audio assets (including music, voiceovers, and sound effects), and any other files or media you write, import into, process within, or bundle with Focused Scribe.
- Non-Infringement: Your imported writing, media, and assets do not and will not infringe upon, misappropriate, or violate any third-party copyright, trademark, trade secret, privacy, publicity, or other proprietary or contractual right.
- Sole Responsibility for Exports: When you utilize compilation, screenplay exports (such as standard industry XML
.fdx, Fountain .fountain, Print / PDF, and Actor Sides), narrative spreadsheet exports (such as CSV, Markdown tables, and Grid JSON .grid.json), Stacks story boards (JSON), manuscript diff archives, or peer-review sharing packages, you are exclusively and solely responsible for ensuring that all embedded writing, dialogue, artwork, and audio files comply with applicable copyright and intellectual property laws.
3. Third-Party Trademarks & Non-Affiliation
Focused Scribe is an independent creative writing and narrative design software application. All trademarks, service marks, trade names, product names, and logos appearing or referenced on Focused Scribe or within our documentation are the property of their respective owners.
Any use of third-party names, trademarks, services, or technical specifications is strictly for technical identification, compatibility, and nominative interoperability. Focused Scribe is an independent authoring application and is not affiliated with, sponsored by, authorized by, or endorsed by any third-party entities or trademark holders.
4. User Responsibility for Data Backups & Local Storage
Important: Maintain Offline Backups of Your Writing
You are solely responsible for maintaining regular, independent backup copies of all your manuscripts and writing. Focused Scribe provides built-in, one-click export features across all studios (Manuscript JSON/Markdown/TXT, Screenplay Fountain/FDX/PDF, Stacks Board JSON, and Grid Spreadsheet CSV/JSON) specifically so you can save offline copies to your computer or preferred backup drives at any time.
Focused Scribe operates with a local-first design across its 5 studio workspaces (Pantser drafting, Screenwriter screenplays, Stacks story boards, Grid spreadsheets, and Editor diff snapshots):
- Browser Data Clearance: If you use Focused Scribe in Guest mode or clear your browser's history, cookies, cache, or site data (IndexedDB/LocalStorage), your locally stored manuscripts and studio projects will be permanently removed by your browser.
- Accidental Deletions: If you delete a document, chapter, screenplay block, spreadsheet cell, or story card within the interface, or confirm a reset, the action is permanent.
- No Duty of Recovery: We have no obligation to store, maintain, or recover lost, deleted, or corrupted manuscripts resulting from user error, browser cache purges, hardware failure, operating system updates, or device loss.
5. Account Security & Loss of Access
Authentication is managed by Clerk (clerk.com):
- Your Responsibility: You are solely responsible for maintaining the security and secrecy of your login credentials and any third-party accounts (such as your Google or Discord accounts) linked to your login.
- Lost Access: Focused Scribe is not responsible or liable if you lose access to your third-party Google or Discord accounts, forget your authentication credentials, or delete your Clerk account. If you lose access to the email or authentication provider you used to register, we cannot bypass security safeguards to retrieve your synchronized data.
6. Age Requirements & Discord Community (18+)
Focused Scribe is designed for writers, and we enforce strict age limits:
- General Service & Cloud Sync: You must be at least 13 years of age (or the minimum age of digital consent in your country) to create an account or use cloud synchronization. We do not knowingly collect personal information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA).
- Discord Community (Strictly 18+): The Focused Scribe Discord server is an adults-only space (18+). Minors under the age of 18 are strictly prohibited from joining, participating in, or communicating on our Discord server. Any user discovered or suspected to be under 18 years of age will be banned immediately without warning.
7. Acceptable Use
You agree to use Focused Scribe solely for lawful writing and productivity purposes. You agree not to attempt to reverse engineer, attack, disrupt, overload, or inject malicious scripts into Focused Scribe or our backend infrastructure.
8. Disclaimer of Warranties ("As Is")
The service is provided "AS IS" and "AS AVAILABLE". Focused Scribe and its creators, suppliers, and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Focused Scribe nor its suppliers or licensors make any warranty that the service will be error-free, uninterrupted, bug-free, or that access thereto will be continuous or secure. You understand that you use the service at your own discretion and risk.
9. Limitation of Liability
IN NO EVENT WILL FOCUSED SCRIBE, ITS DEVELOPERS, OWNERS, OR AFFILIATES BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY FOR:
- ANY LOSS OF DATA, CORRUPTION OF MANUSCRIPTS, LOSS OF WRITING, LOSS OF REVENUE, OR COST OF PROCUREMENT FOR SUBSTITUTE SERVICES;
- ANY ACCIDENTAL DELETION, UNRECOVERABLE BROWSER CACHE CLEARS, OR INABILITY TO ACCESS YOUR ACCOUNT OR STORED CONTENT;
- FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; OR
- FOR ANY AMOUNTS EXCEEDING THE TOTAL FEES (IF ANY) PAID BY YOU TO FOCUSED SCRIBE DURING THE TWELVE (12) MONTHS PRIOR TO THE CAUSE OF ACTION.
10. Indemnification
You agree to indemnify and hold harmless Focused Scribe, its developers, contractors, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of your use of the service, any intellectual property infringement or copyright claims relating to writing, content, or assets you import or export, or your violation of these Terms.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace any part of these Terms. It is your responsibility to review these Terms periodically for changes. Your continued use of or access to the service following the posting of any changes constitutes acceptance of those changes.
